These Terms of Service ("Terms") govern your use of Mapperoni and related services ("Service") provided by Canvis Software LLC ("we," "us," or "our"). By using our Service, you agree to these Terms.

1. Acceptance

By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

Mapperoni is a platform for creating projects that collect feedback and responses from the public. We provide tools for building forms, managing teams, and analyzing responses.

3. Accounts

You must provide accurate account information
You are responsible for maintaining account security
You must be at least 16 years old to create an account
One person or entity per account; no shared accounts
Notify us immediately of any unauthorized access

4. Your Content

"Your Content" includes projects, forms, configurations, and any data you upload or create.

You retain ownership of Your Content
You grant us a license to host, store, and display Your Content as necessary to provide the Service
You are responsible for ensuring you have rights to Your Content
You are responsible for response data collected through your projects

5. Response Data

When others submit responses to your projects:

You are the data controller for that response data
You must provide appropriate privacy notices to respondents
You must comply with applicable data protection laws
We process response data on your behalf as a data processor

6. Acceptable Use

You agree to comply with our Acceptable Use Policy. Violations may result in suspension or termination.

7. Fees and Payment

Free tiers are subject to usage limits
Paid plans are billed in advance on a monthly or annual basis
Fees are non-refundable except as required by law
We may change pricing with 30 days notice
Failure to pay may result in service suspension

8. Intellectual Property

We own the Service, including software, design, and trademarks
These Terms do not grant you rights to our intellectual property except as needed to use the Service
Feedback you provide about the Service may be used without obligation

9. Third-Party Services

The Service may integrate with third-party services. Your use of third-party services is governed by their terms. We are not responsible for third-party services.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted service
We may modify, suspend, or discontinue features with reasonable notice
Scheduled maintenance will be announced when possible

11. Termination

By You: You may close your account at any time through account settings.

By Us: We may suspend or terminate your account if you:

Violate these Terms or our policies
Fail to pay fees when due
Create legal liability or risk to others

Effect: Upon termination, your right to use the Service ends. We will delete your data according to our Privacy Policy. Provisions that should survive termination will remain in effect.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or available at all times.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for indirect, incidental, special, consequential, or punitive damages
Our total liability is limited to the greater of (a) fees you paid in the 12 months before the claim, or (b) $100

These limitations apply regardless of the theory of liability.

14. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

Your use of the Service
Your Content and response data
Your violation of these Terms
Your violation of any third-party rights

15. Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

Governing Law: These Terms are governed by the laws of California, USA, without regard to conflict of law principles.

Jurisdiction: Any disputes will be resolved in the courts of California, USA, and you consent to personal jurisdiction there.

16. General

Entire Agreement: These Terms, along with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement
Severability: If any provision is unenforceable, the remaining provisions remain in effect
Waiver: Failure to enforce a provision is not a waiver
Assignment: You may not assign these Terms; we may assign them in connection with a business transfer
No Agency: Nothing creates a partnership, employment, or agency relationship

17. Changes

We may modify these Terms at any time. Material changes will be notified via email or platform notice at least 30 days in advance. Continued use after changes constitutes acceptance.
